Terms of Service

1. Agreement
These Terms of Service ("Terms") govern access to and use of the ServiceStead application and website (the "Service"), operated by ServiceStead ("ServiceStead," "we," "us"). By creating an account or using the Service you agree to these Terms on behalf of yourself and, where applicable, the business you represent (your "Organization"). If you do not agree, do not use the Service.
2. The Service
ServiceStead is field-service management software for property maintenance businesses: customer and property records, quotes, job scheduling and dispatch, field crew workflows, invoicing, payment tracking, communications, reporting, and optional integrations with third-party services. The Service is currently offered as a private beta and may change, add, or remove features without notice.
3. Accounts and Organizations
You must provide accurate account information and keep your credentials secure; you are responsible for activity under your account. Organization owners and administrators control membership, roles, and settings for their Organization and are responsible for authorizing their team's access.
4. Your Data
Your Organization owns the business records it enters into the Service (customers, contacts, properties, jobs, photos, invoices, and similar content). You grant us the limited rights needed to host, process, transmit, and display that data in order to operate the Service. We do not sell your data. Our handling of personal information is described in the Privacy Policy.
5. Acceptable Use
You agree not to misuse the Service, including by: violating applicable law; sending spam or unlawful communications through it; uploading malicious code; attempting to access other organizations' data; reverse engineering the Service; or reselling it without our written consent. You are responsible for obtaining any consents required to contact your customers (for example, for SMS or email) and for the accuracy of invoices and records you issue.
6. Payments and Third-Party Integrations
Payment processing between your Organization and its customers is provided by Stripe under Stripe's own terms; ServiceStead does not store card numbers. If you connect an accounting integration (such as QuickBooks Online or Xero), you authorize ServiceStead to exchange data with that provider on your Organization's behalf as described in the integration settings, subject to that provider's terms. You may disconnect an integration at any time. Third-party services are not under our control and we are not responsible for them.
7. Fees
The private beta is provided free of charge. If we introduce paid plans, we will provide notice and the applicable pricing before you incur charges. Payment-processing fees charged by Stripe on your customer payments are separate and are disclosed by Stripe.
8. Availability and Beta Disclaimer
We aim for high availability but the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Beta software may contain defects. You are responsible for maintaining your own records where the law requires it (your accounting system remains your system of record for financial data).
9. Limitation of Liability
To the maximum extent permitted by law, ServiceStead will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from or related to the Service. Our total liability for any claim is limited to the greater of $100 or the amounts you paid us for the Service in the twelve months before the claim.
10. Termination
You may stop using the Service at any time and may request deletion of your Organization's data by contacting us. We may suspend or terminate access for breach of these Terms, for legal reasons, or upon discontinuation of the Service with reasonable notice. Sections that by their nature should survive (including 4, 9, and 11) survive termination.
11. General
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of law rules. If any provision is unenforceable, the rest remain in effect. We may update these Terms; material changes will be notified through the Service or by email, and continued use after the effective date constitutes acceptance.
